David Welder is an attorney with a construction background who focuses on civil litigation and arbitration. With that background, he represents design professionals, developers, contractors and suppliers in complex construction matters all across the country.  David has handled virtually every type of claim that could arise from a construction project and also has substantial experience assisting on the front end of developments.

David also has extensive experience representing business owners in a variety of commercial litigation (including tortious interference, covenants not to compete, fraud, breach of contract and breach of fiduciary duties).  His practice also includes civil rights (Section 1983 claims), personal injury and other matters.

Representative Experience

David Welder and Courtney McCray obtained a defense verdict after a 6-day jury trial in Riley County, Kansas.  They represented a structural engineer in a professional negligence claim involving a real estate transaction wherein there were claims related to a structural inspection performed by the engineer.  The last pretrial settlement demand was $485,000.

Won summary judgment for Installtec, Inc. and K Building Specialties, Inc., subcontractors on a construction project in Johnson County, Kansas, regarding a $3,000,000 indemnity lawsuit brought by another subcontractor related to a jobsite accident.  This judgment was upheld by the Kansas Court of Appeals.  Great Plains Roofing and Sheet Metal, Inc. v. K Building Specialties, Inc.

David recently obtained a $650,000 jury verdict in the U.S. District Court for the Eastern District of Missouri for his client against a police officer in a police brutality civil rights case that had been ongoing for over 9 years.
