Brad Carney is a partner at the law firm of Maraziti Falcon, LLP, where he advises and represents his clients in the areas of construction law; procurement of construction bids, including bid challenges; and the Local Redevelopment and Housing Law.
Mr. Carney advises a variety of clients regarding construction projects, drafting of construction contracts, change orders, releases and the Municipal Mechanics Lien Law. He defends his clients regarding construction claims for differing site conditions, equitable adjustments in the contract price and contract time, change order disputes, delay, disruption, loss of productivity, extended home office overhead, extended engineering costs and warranty claims.
Mr. Carney represents various municipalities in the negotiation of redevelopment agreements for projects involving environmentally contaminated sites and has defended challenges to redevelopment plans, redevelopment area designations, and the acquisition of industrial and commercial properties necessary for mixed-use redevelopment projects. He also represents municipal county utilities authorities and sewerage authorities on issues relating to public water supply and solid waste flow control, sewerage infrastructure construction disputes, connection fees and sewer user fees, respectively.
Mr. Carney has been engaged in the procurement of single stream recycling and NJDEP permit compliance for solid waste capacity and air permitting issues involving solid waste transfer stations. He has litigated issues regarding public water supply for a number of inclusionary developments. Mr. Carney has litigated the enforcement of host community benefit payments involving a coal-powered cogeneration plant for the production of electricity and steam. He represents a variety of clients in connection with Green Acres diversion matters, including the disposal and replacement of funded and unfunded parkland necessary for public purposes.
Mr. Carney is an experienced litigator representing the firm’s clients in federal and state courts, alternative dispute resolution and before administrative agencies.

Construction claim disputes are very technical and usually present a variety of complex issues. Maraziti Falcon, LLP also represents its clients in the defense of litigated bid challenges, from the administrative level through the appeals process.
During the course of any construction project, a contractor’s claims may include damages related to differing site conditions, equitable adjustments, change orders, delay, disruption, loss of productivity, acceleration, withholding of payment, the date of substantial completion, scheduling disputes and such other claims. These types of claims are highly fact sensitive and usually turn on the legal interpretation of the language in the construction contract as well as the technical advice provided by the consulting engineer. Maraziti Falcon, LLP’s construction practice focuses on these complex claims and has the relevant experience in crafting defenses based upon termination for cause, liquidated damages, and post warranty claims. When warranted by the circumstances, Maraziti Falcon, LLP also assists its clients in the negotiation of takeover agreements with the surety in order to achieve project completion.
